Parents of man killed by lion sue

The parents of Mark Reynolds, the 34-year-old man killed by a mountain lion in Whiting Ranch Wilderness Park, are suing Orange County.

In a wrongful-death lawsuit filed in Orange County Superior Court and made public this week, Donna and Gary Reynolds of St. Joseph, Mo., said the county should have known that the park was in "dangerous condition" because cougars prowled it.

Mark Reynolds was mountain biking Jan. 8, 2004, when he was killed. It was the first mountain lion fatality in Orange County history.

The lion also attacked another biker and was later killed.

A county spokeswoman declined to comment.

A sad turn for a sad event...
"Hey honey, let sue the OC and grab a hunk of cash." I think I understand why he moved away from the parents.
I guess there are predators in Missouri too....
I am sorry that I participated in the memorial ride.
There are signs posted everywhere stating that it is the Wilderness Park and that Mountain Lions are frequent visitors.
Greed sucks!

    Couldn't agree more. Everyone enters the wilderness at their own risk.

    What should the County have done to prevent his death? Killed all the mountain lions? Erect a tunnel of barb wire over the top of all trails and fireroads to prevent mountain lion attacks?

    It is sad that he died, but lawsuits like this make my blood boil.

    I don't mean to down play the grief that the Reynolds family suffered from Mark's death, but....

    Come on.. You have got to be kidding me ! This can be motivated by nothing more than greed. I didn't know Mark personally, but from the info I have read about him he seemed to be a guy who was a seasoned rider who loved riding in the foothills and was probably well aware of what creatures inhabited the places where he rode.

    I seriously doubt that Mark would approve of such a lawsuit. If the parents of Mark Reynolds win this lawsuit (slim chance), the ramifications could be staggering. This could potentially put an end to riding in places where Mark himself spent much of his time. From what I read about Mark, he focused both his career and recreation around sports and the outdoors. The fact that his family is attacking the very thing that their son loved so much is beyond pathetic.

    The very existence of this litigation soils the memory of an avid mountain biker...it's jus sad.

    Sickening - these people should be ashamed of themselves

    a favorable verdict would be horrible to mountain biking and all other outdoor recreation - especially in areas as urban as where this occured...someone else said it above - should the County have executed all mountain lions? should the county have banned mountain biking? Everyone was so sad at the loss of Mark - his charity work etc. - it is a total shame his family is screwing up this badly

        I wonder how nature loving Montana residents feel about this fiasco.

        Even so the Reynolds are urban dwellers in their own right , I now that
        there's got to be more wild life out there than in SoCal, not counting the cow's that is.

      Dudes it is a memorial fund.
      Do you even know if the money goes to his family or to the project that Mark started to provide bikes to kids that can't afford them.
      Let's get some facts people and calm the fock down.
      Talk about flying off the handle.
      I will call Bev and Jerry who run Rim Nordic and find out the facts.
      Until then let cooler heads prevail.
      I for one am proud I was at the memorial. At the time the cause was a just one and served a purpose for the whole mtb comunity to come together and do something positive in the light of such a tragedy.
      It is too bad that his family still can't deal with his death and are taking these steps.
      There wouldn't even be a case unless there was a lawyer who was will to bring it.
      The whole thing just sucks.

          Still if a lawyer was dangling some huge carrot of a settlement, I imagine they jumped at it.
          My point was they shouldn't even be able to file because any self respecting lawyer should tell them that their case is in bad taste, it is un-ethical and they have no chance to win. You get my point. It is frivolous and shouldn't even be entertained by any court or lawyer. Believe me both parties should be ashamed.

        Sorry but I can't do that. I feel for MR and his death was tragic in nature and I am sure a complete and utter shock to his family. What does this accomplish? Nothing but wasting our tax dollars for what?

    Very disheartening to hear of the parents taking that route. His death was a freak accident of nature. Have to believe that Mark would have strongly dis-approved of their decision.

      Well, my air-bag collection is smaller by one after hearing this. And, a lot of lawyers do go beyond solicitation and into baiting, if not heckling, future clients into coming to be.

        Who knows anything about the Mark Reynolds Foundation?
        Is the money just for his parents or does it go to his project?
        I just heard Bev at Rim Nordic. They only make a flat donation from the proceeds collected from the raffle they run that weekend only.
        I am sure it is only a couple of hundred bucks at most.
        Not a good reason to boycott such a good series or people.

          I'm responding to the spirit of the lawsuit in general as implied; I know nothing of Rim Nordic. I'm still sorry I couldn't be at the memorial. My gun is fully holstered and it is really not THAT big of a deal. I don't hate lawyers and I've never met Marks parents. There is NOTHING like a good lawyer to keep you from being eaten by a bad one smile If Bev is a friend of yours, she's alright by me. Now I need to get back on the phone to book a ticket to somewhere so I can replace that bag in my collecton wink

    I know this is just going to fire people up but here goes...

    Looks like Mark's Parents are the individuals who run the Mark Reynolds Memorial Bike Fund (see info below). After hearing about this latest litigation, I imagine that many people will no longer want to support the events that benefit this fund (rim nordic) , but lets hope that the funds sent to this worthy foundation can not be used for other purposes (which is probably the case). The foundation has raised a lot of money to provide bikes to kids, so lets hope that the absurd actions by his parents will not tarnish the future of this foundation.     It's hard to believe that his parents are too stupid to see the fact that their actions might indirectly effect funds donated to Marks foundation. As hard as it may be, lets try not to jump the gun on this and assume that money from this foundation could go towards this frivolous litigation.

    I'm just as pissed off about this lawsuit as anyone, but we all should try and separate our anger about this lawsuit (which is justified), from the fantasic charitable work done by the Mark Reynolds Memorial Bike Fund.

    I am a firm believer in taking stances on issues, especially when it comes to mountain biking and standing up for our sport.

    It’s easy for us to spend a lot of time posting about trails, bike parts and adventures, but it’s difficult sometimes to put effort into getting involved. This is a time to get involved however.

    I think I’m pretty consistent on standing up for access issues, and sometimes that takes the form of e-mails, phone calls, letters to badger the County Parks and the County Supervisors; or by showing my face at the meetings to let them know these issues are not forgotten. But in this case I think we need to stand firm with the County and send letters of support to the County Parks and the Supervisors stating our personal positions on this law suit.

    I believe that the County has zero liability on this issue and has demonstrated legitimate due diligence in all of the wilderness areas by making the hazards known to the park users.

    Please take the time to write polite letters to the Reynolds family letting them know that this was simply an unfortunate and unusual incident and no one is to blame; and also send letters to the County to demonstrate to them that we are here to support them in this case. I think it would be difficult for anyone to win a case against the County if there were hundreds or thousands of local trail users who were willing to stand up and state that we are all clearly aware of the dangers of the wilderness areas and feel that the County has fully warned us of these dangers.

    We need to put just as much effort into this as we do into badgering the County to get off their duff and get the RMP review for Aliso-Woods started. We should always try to stay consistently involved in the issues that pertain to our sport and trail access.

    Get your letters out to the Family and to the County by the end of the week.

    My Current Letter to the Reynolds Family.


    I too am distressed at this frivolous law suit. I met mark on numerous occasions on the trails near Whiting, and I’m sure he was well aware of the inherent risks of riding alone in a wilderness area as most of us are. Even with all of the warning signs posted at the park entrances, and the postings of recent lion sightings; many of us still proceed to ride and train alone knowing that it is still extremely rare to even catch a glimpse of a lion in Orange County. Every single time I enter a Federal, State or County gate past the wilderness warning signs; I put the responsibility for anything that may befall me solely on my shoulders………..as did Mark.

    As mountain bikers, we are at a much greater risk of injury or death from our own actions than of those from any wild predator. Mark’s unfortunate incident was a rare and unusual event that no one could have predicted; and no one can be blamed for except Mark. We all make our own choices in life and Mark made the precise same choice that many wilderness users make every day throughout the county (ie…to enter a known wilderness alone for personal pleasure with the full knowledge and information that there is an inherent risk to do so).

    I grieve for Marks untimely death, and sympathize with his family’s loss; but his family needs to realize that no one was to blame here, and they need to rescind this frivolous law suit and stop making a mockery of the judicial system. Good things and bad things happen in life, and many times things happen that are out of the control of everyone.

    I would appeal to his family to please stop this insanity and let the good that Mark did in life be remembered, and the good that continues through his foundation continue to thrive. Mark was by no means a self-centered greedy person; and this law suit simply is not the way Mark would want his memory to be represented.

    I appeal to his family to do the right thing and to try to live with the same zest and respect that Mark demonstrated. Greed or vengeance had no place in Marks life and should not be a part of his death or his memory. He was too good of a person to deserve this type of negative aftermath.

    As one of the primary organizers of the benefit ride for Mark and Anne, I'm not thrilled in the least.

    However, while I don't agree with Dona's actions in the least, I do believe that what we did that day, January 31st, 2004, was for a good cause and that money has come back and helped our community this past year.

    The money was split evenly between Mark's family and Anne, Mark's share being spent on something near and dear to his heart; bikes for kids. It was done just before Christmas '04 and bikes were given to children of needy families in Orange County, furthering the worthy cause that Mark held close and helping kids to love bikes the way we all do.

    What I'm trying to say here is that your efforts last January were put to the right cause; kids and Anne's bills and recovery. Let's not degrade the amazing event and community that you all became because of one person's lack of understanding and perhaps misplaced ill will.

    No matter how much of a nightmare it was to put on, I would do it again if the money were going to needy kids and Anne's medical bills. However, going forward, I would ask organizations related to cycling be informed as to how this chairity that Dona runs is affecting our sport and passion and hopefully make a wise decision as to the status of their donations. I'm sure there is another local program that does the same thing...

    Oh yeah, SHARE did it last year with twenty bikes unrelated to Dona's giveaway.

    Back into my salad years...

      Well said, Grant.

      I remain proud of having supported that event, being in a sport with "ambassadors" like you and the crew that made it happen and to have had a chance to speak momentarily to Mark's mom up on top of that hill, even though I never met the guy. I'd do all that all over again and I don't think ANY of this discussion is to the detriment of the Intent and Effect of the event for Mark and Anne.

    Ouch! I was shocked to hear about the lawsuit. It made me think twice about my donation, but GC is right, it did all go to a good cause. The community came together and supported Mark and his parents, so I really hope they do the right thing and drop it.

    If this does go to court, I would be the first one to sign a petition stating "as a mountain biker, I am fully aware of the dangers in the wilderness, and enter at my own risk." I don't think Mark's parents realize that the same group who came together for them will now have to work against them. Very sad.

    Due to overwhelming support, for our son Mark Reynolds, an avid biker in the last week.

    Our intention was not to upset his friends, fellow bikers, biking clubs and National Biking Associations, biking related companies, nor the trails in which the enjoyment of biking prevails..

    The Reynolds Family felt safety issues were a prime concern.

    Legal Council will be instructed to dismiss the filing in Orange County, California

      To the Reynolds Family:
      Thank you for your decision to withdraw the lawsuit.
      Even though most of us never met Mark we know the spirit of a mountain biking that lives in us all. In that way we can all empathize with his love of the sport and your love of him. His death affected us all as a community in a very personal way. Recently you may have heard of another mountain biker who lost his life in crash here in the Santa Monica mountains. I just road past the crash site tonight. I feel for his family and friends.
      Our sport has its dangers but for a lot of us that is what makes it worthwhile. If it were something totally safe like bowling or tennis I don't think the sport would have the appeal it does. It appeals to many different types of people on many levels and in that we can all unite.
      The memorial for Mark was a great event and brought many people together in support of Mark's and our love of the sport. I felt a great sense of pride to have been part of that community of strangers who came together that day, and every day since. I don't see or hear of that kind of movement in the other type of cycling communities. In a town as large as Los Angeles and its surrounding area, it was amazing to get that many folks together for someone they didn't know personally. I feel it somehow is a testament to they type of character your son was and what he wanted for others, specifically the kids. I am glad to hear that Mark's name will continue to represent that spirit and good will to others that it has since come to represent since his untimely death. Thank you for considering our welfare in pursuing what we so love to do.
      Thank you again for choosing not to take any further legal action.

        That's a very sensible and wise decision by The Reynolds family. I bet a sly attorney got his/her paws on them and made them believe they'd be rich. I'm glad to read the good news to the contrary. Grant (and everyone else who wrote on The Reynolds site), great job!
